Terms of Service

1. Interpretation and Jurisdiction
1.1 By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Everyone's Driving School - ABN 15 687 007 478.
1.2 These Terms of Service constitute a legal agreement between you (the “student”) and Everyone’s Driving School (referred to as “we,” “us” or “our”).
1.3 By booking a lesson, you confirm that you have read, understood, and agree to be bound by these Terms, which are governed by the laws of Queensland, Australia.
1.4 Everyone's Driving School reserves the right to update and change the Terms of Service without notice.
1.5 Any disputes arising under these Terms will be resolved in accordance with Queensland law and Australian Consumer Law.

2. Lesson Booking, Payments and Fees
2.1 Lessons must be booked in advance via our online booking system and are subject to availability.
2.2 Full payment is required at the time of booking unless you have an active lesson package (see Section 4)
2.3 All lesson purchases — whether individual or as part of a package — expire six (6) months from the date of purchase.
2.4 Lessons are not transferable to any other student.
2.5 You may book a lesson on behalf of someone else, provided that the full name, contact information, and learner permit number of the person attending is disclosed during the booking process.
2.6 Weekend surcharges apply and are automatically added during booking:
    2.6.1 Night Lessons (after 5pm on a weekday): $30
    2.6.2 Saturday lessons: $30
    2.6.3 Sunday lessons: $60
    2.6.4 All pricing includes GST and is subject to change with notice.
    2.6.5 Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Everyone's Driving School for payment processing.
    2.6.6 All fees and transactions are in Australian Dollars.

3. Cancellations, Rescheduling and No-Shows
3.1 You may cancel or reschedule a lesson up to 48 hours before its scheduled time without incurring a fee.
3.2 Cancellations made between 24 and 48 hours prior to the lesson will incur a 50% cancellation fee.
3.3 Cancellations made with less than 24 hours’ notice or failure to attend a lesson will result in a 100% cancellation fee.
3.4 Changes must be submitted via your client portal or by contacting us directly.
3.5 While every effort is made to honour the exact booking time selected, lesson times may occasionally need to be adjusted by up to 45 minutes earlier or later than the scheduled time due to practical scheduling needs, such as driving test appointments or optimising route efficiency. By booking a lesson, you acknowledge and accept that such adjustments may occur and will be communicated in advance wherever possible.

4. Prepaid Packages and Credit Expiry
4.1 Lessons purchased as part of a package are issued as credits to your account.

4.2 All prepaid lessons and credit packages expire six (6) months from the date of purchase.
4.3 Expired credits cannot be extended, reinstated, or refunded.
4.4 Credits are non-transferable and can only be used by the student they were originally assigned to.
4.5 Each standard lesson deducts one (1) credit; night and weekend surcharges apply as per Section 2.6.

5. Refunds
5.1 Refunds are processed in accordance with the Australian Consumer Law.
5.2 No refunds will be issued for cancellations made with less than 24 hours' notice.
5.3 A 50% refund may be considered for cancellations made between 24 and 48 hours before the lesson, at our discretion.
5.4 Refunds are issued to the original purchaser and payment method only.
5.5 Refunds will not be granted for expired credits.

6. Liability, Insurance and Use of Vehicles
6.1 All reasonable efforts are made to ensure lessons are delivered safely and
professionally.
6.2 Lessons in instructor-provided vehicles are covered by our comprehensive motor insurance.
6.3 Any insurance excess must be paid by the student for any incidents that occur during a driving lesson.
6.4 If you supply your own vehicle, it must be:
     6.4.1 Fully registered and roadworthy
     6.4.2 Covered by valid comprehensive insurance
     6.4.3 Approved for use by learner drivers
     6.4.4 We are not liable for injury, loss, or damage sustained during lessons, except where required by law.

7. Student Obligations and Conduct
7.1 You must:
     7.1.1 Hold and present a valid learner permit or provisional licence at each lesson
     7.1.2 Be punctual and ready at the agreed pickup location
     7.1.3 Follow instructor instructions and obey Queensland road rules
     7.2 Attending a lesson under the influence of alcohol or drugs will result in immediate cancellation without refund.
     7.3 You are responsible for any fines or legal infringements incurred while driving your own vehicle or an instructor vehicle during a lesson.
     7.4 You are responsible for maintaining the security of your account and password. Everyone's Driving School cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
     7.5 By purchasing from Everyone's Driving School, you agree not to initiate any credit card chargeback, or dispute any payment made for services, products, digital goods, Vouchers or gift cards purchased, except in cases of proven fraud or unauthorised transactions. All disputes must be resolved directly with Everyone's Driving School.
     7.6 You must not post or submit false information to the Service.
     7.7 You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
     7.8 You are responsible for all activity that occurs from your account.

 

8. Privacy and Personal Data
8.1 We collect and store personal information to facilitate lesson delivery, including names, contact details, permit numbers, and emergency contacts.
8.2 This information is managed in accordance with the Privacy Act 1988 (Cth).
8.3 Your data will not be disclosed to third parties without consent, unless required by law.
8.4 You may access, correct, or request deletion of your personal information at any time by contacting us in writing.

9. Weather, Emergencies and Instructor Availability
9.1 Lessons may be postponed due to extreme weather, instructor illness, vehicle issues or other emergencies.
9.2 If we must cancel a lesson, you will be contacted and offered a rescheduled time at no additional cost.

10. Amendments to Terms
10.1 We may update these Terms and Conditions periodically
10.2 Changes will be posted to our website (www.everyonesdrivingschool.com) and/or emailed to current clients at least 14 days before taking effect.
10.3 Continued use of our services constitutes your agreement to the updated Terms.

11. Severability
11.1 If any part of these Terms is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

12. General Conditions
12.1 Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
12.2 You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Everyone's Driving School.
12.3 Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Everyone's Driving School customer, employee, member, staff, officer or external  contractor will result in immediate account termination.
12.4 You must not transmit any worms or viruses or any code of a destructive nature.
12.5 You understand that Everyone's Driving School uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
12.6 Everyone's Driving School does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material
purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
12.7 You expressly understand and agree that Everyone's Driving School shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Everyone's Driving School has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.

12.8 The failure of Everyone's Driving School to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision

 

13. Account Terms
13.1 This page contains the most current version of the Terms of Service.
13.2 Accounts registered by "bots" or other automated methods are not permitted and will be removed.
13.3 Everyone's Driving School has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Everyone's Driving School service, for any reason.
13.4 Violation of any of the terms or general conditions may result in the termination of
your Account.

14. Acceptance
14.1 booking or attending a lesson, you acknowledge that you:

• Have read and understood these Terms and Conditions

• Accept and agree to them in full

• Agree that Everyone's Driving School can send you booking reminders, relevant

information and other marketing via phone, SMS and/or email. You can opt out of any  marketing.
