Terms of Service
1. Interpretation and Jurisdiction
1.1 By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Everyone's Driving School - ABN 15 687 007 478.
1.2 These Terms of Service constitute a legal agreement between you (the “student”) and Everyone’s Driving School (referred to as “we,” “us” or “our”).
1.3 By booking a lesson, you confirm that you have read, understood, and agree to be bound by these Terms, which are governed by the laws of Queensland, Australia.
1.4 Everyone's Driving School reserves the right to update and change the Terms of Service at any time.
1.5 Any disputes arising under these Terms will be resolved in accordance with Queensland law and Australian Consumer Law.
2. Lesson Booking, Payments and Fees
2.1 Lessons must be booked in advance via our online booking system and are subject to availability.
2.2 Full payment is required at the time of booking unless you have an active lesson package (see Section 4)
2.3 All lesson purchases — whether individual or as part of a package — expire six (6) months from the date of purchase.
2.4 Lessons are not transferable to any other student.
2.5 You may book a lesson on behalf of someone else, provided that the full name, contact information, and learner permit number of the person attending is disclosed during the booking process.
2.6 Surcharges apply to lessons conducted outside standard weekday daytime hours and are calculated as a percentage of the applicable lesson or package rate. These surcharges are applied proportionally based on the duration of the lesson. Where possible surcharges will be automatically processed within 48 hours of the booking. Where this is not possible, invoices will be emailed within 48 hours of the booking and must be paid within 3 business days or 7 days prior to the booking, whichever comes first.
2.6.1 Night Lessons (after 5:00pm on weekdays): 25% loading applied to the lesson rate 2.6.2 Saturday lessons: 25% loading applied to the lesson rate
2.6.3 Sunday lessons: 50% loading applied to the lesson rate
2.6.4 Public Holiday lessons: 75% loading applied to the lesson rate
2.6.5 Where a package is used, the surcharge is calculated based on the equivalent lesson
value within that package.
2.6.6 Surcharges are automatically calculated and added at the time of booking.

2.7 Surcharges apply to all standard lessons and applicable packages unless otherwise specified.
2.8 All pricing includes GST and is subject to change.
2.9 All transactions are processed using secure, PCI-compliant payment systems.
2.10 All fees and transactions are in Australian Dollars.
3. Cancellations, Rescheduling and No-Shows
3.1 You may cancel or reschedule a lesson up to 48 hours before its scheduled time without incurring a fee.
3.2 Cancellations made between 24 and 48 hours prior to the lesson will incur a 50% cancellation fee.
3.3 Cancellations made with less than 24 hours’ notice or failure to attend a lesson will result in a 100% cancellation fee.
3.4 Changes must be submitted via your client portal or by contacting us directly.
3.5 Lesson times may be adjusted by up to 45 minutes earlier or later due to operational requirements.
3.6 An administration fee may apply to late changes, failed payments, or manual booking adjustments. This fee will be communicated at the time of charge.
4. Prepaid Packages and Credit Expiry
4.1 Lessons purchased as part of a package are issued as credits to your account.
4.2 Lesson availability is subject to demand and may be booked up to eight (8) weeks in advance. It is the responsibility of the student to book lessons in advance to ensure availability within the validity period of their credits or vouchers. Everyone’s Driving School is not responsible for unused or expired credits due to limited lesson availability or failure to book in advance.
4.3 All prepaid lessons and credit packages expire six (6) months from the date of purchase.
4.4 Expired credits cannot be extended, reinstated, or refunded.
4.5 Credits are non-transferable.
4.6 Each lesson deducts credits based on the lesson duration booked.
4.7 Starter Pack is available to new students only and may be purchased once per student.
4.8 Surcharges apply to package bookings where relevant.
5. Refunds
5.1 Refunds are processed in accordance with the Australian Consumer Law.
5.2 Lesson Cancellations and Account Credits
Where a lesson is cancelled in accordance with Section 3, the applicable lesson fee will be issued as an account credit or voucher for future use. Refunds are not automatically provided.
If a student wishes to request a refund, they must submit a written request to info@everyonesdrivingschool.com. All refund requests are subject to assessment and approval in accordance with Australian Consumer Law and these Terms of Service.
5.3 No refunds will be issued for cancellations made with less than 24 hours' notice.
5.4 Refunds for cancellations between 24 and 48 hours may be issued at our discretion.
5.5 Refunds are issued to the original purchaser and payment method only.
5.6 Refunds will not be granted for expired credits.
6. Liability, Insurance and Use of Vehicles
6.1 All reasonable efforts are made to ensure lessons are delivered safely and professionally.
6.2 Lessons conducted in instructor vehicles are covered by appropriate insurance.
6.3 Any applicable insurance excess may be payable by the student in the event of an incident.
6.4 If you supply your own vehicle, it must meet all legal and safety requirements.
6.5 We reserve the right to allocate lessons to different instructors and vehicles based on operational requirements.
7. Student Obligations and Conduct
7.1 You must hold a valid licence or permit and follow all instructions.
7.2 You must not attend a lesson under the influence of drugs or alcohol.
7.3 You are responsible for fines or infringements incurred during a lesson.
7.4 You are responsible for maintaining the security of your account.
7.5 You must not misuse the Service or provide false information.
8. Privacy and Personal Data
8.1 Personal information is collected to deliver services.
8.2 Information is managed in accordance with the Privacy Act 1988 (Cth).
8.3 Data will not be disclosed unless required by law.
9. Weather, Emergencies and Instructor Availability
9.1 Lessons may be postponed due to weather, illness or operational issues.
9.2 Where possible, lessons will be rescheduled at no additional cost.
10. Child Safety Obligations
10.1 Where services are provided to persons under 18 years of age, Everyone’s Driving School complies with applicable Child Safe Standards from 1 April 2026.
10.2 We are committed to providing a safe environment that promotes the wellbeing and cultural safety of all young people, including Aboriginal and Torres Strait Islander children.
11. Amendments to Terms
11.1 We may update these Terms periodically.
11.2 Updates will be published on our website.
11.3 Continued use of services constitutes acceptance of updated Terms.
12. General Conditions
12.1 Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
12.2 You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Everyone's Driving School.
12.3 Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Everyone's Driving School customer, employee, member, staff, officer or external contractor will result in immediate account termination.
12.4 You must not transmit any worms or viruses or any code of a destructive nature.
12.5 You understand that Everyone's Driving School uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
12.6 Everyone's Driving School does not warrant that:
(i) the website will meet your specific requirements,
(ii) the website will be uninterrupted, timely, secure, or error-free,
(iii) the results that may be obtained from the use of the website will be accurate or reliable,
(iv) the quality of any products, websites, information, or other material purchased or obtained by
you through the website will meet your expectations, and
(v) any errors in the website will be corrected.
12.7 You expressly understand and agree that Everyone's Driving School shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Everyone's Driving School has been advised of the possibility of such damages), resulting from:
(i) the use or the inability to use the website.
(ii) the cost of procurement of substitute goods and services resulting from any goods, data,
information or services purchased or obtained or messages received
or transactions entered into through or from the website.
(iii) unauthorised access to or alteration of your transmissions or data.
(iv) statements or conduct of any third party on the website.
(v) or any other matter relating to the website.
12.8 The failure of Everyone's Driving School to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision
13. Account Terms
13.1 This page contains the most current version of the Terms of Service.
13.2 Accounts registered by "bots" or other automated methods are not permitted and will be removed.
13.3 Everyone's Driving School has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Everyone's Driving School service, for any reason.
13.4 Violation of any of the terms or general conditions may result in the termination of your Account.

14.1 Booking or attending a lesson, you acknowledge that you:
